CIS Regulation of Public-Private Partnership in IT-Sphere Considered in Tavricheskiy Palace

On 18 May 2023, a meeting of the IPA CIS Permanent Commission on Legal Issues was held at the Tavricheskiy Palace – the headquarters of the Interparliamentary Assembly of the Commonwealth of Independent States.

The meeting was opened by Chair of the Commission, Chair of the Committee of the Majlisi namoyandagon of the Majlisi Oli of the Republic of Tajikistan on Legislation and Human Rights Ravshan Rajabzoda. Secretary General – Head of the IPA CIS Council Secretariat Dmitriy Kobitskiy took part in the event.

He announced that by the decision of the IPA CIS Council Chief Advisor to the Committee of the Federation Council of the Federal Assembly of the Russian Federation on Economic Policy Valeriy Bokarev was awarded the medal “For Strengthening Parliamentary Cooperation” and the anniversary medal “IPA CIS. 30 years” for merits in the development and strengthening of parliamentarism, for contribution to the development and improvement of the CIS legal framework, strengthening international relations and inter-parliamentary cooperation.

The Secretary General of the IPA CIS Council presented the awards and noted that Valeriy Bokarev participated in the adoption of the Model Laws on the Protection of Property rights, on Public Servitudes, on Entrepreneurship, on Public Real Estate Registration, on Assessment Activity, etc.

Chair Yuriy Kozlov ofof the IPA CIS Expert Advisory Board on Legal Issues told about the meeting of the Board held on 11 May 2023 and the proposals for model legislation..

Member of the Commission, member of the Committee of the Federation Council of the Federal Assembly of the Russian Federation on Constitutional Legislation and State Building Alexander Bashkin and Acting Head of the Civil Law Department of St. Petersburg State University Anton Rudokvas briefed the meeting participants on the progress of work on the draft Model Law on Agreements on Transfer of Property into Ownership.

The document regulates agreements on the transfer or alienation of property into ownership. It specifies the regulation of the parties’ obligations under contracts of sale, exchange, donation, rent and its varieties. It describes the national regulation of private issues related to the conclusion and execution of agreements on the alienation of property into ownership within the framework of the established principles.

The members of the commission proposed to finalize the draft law taking into account the suggestions and comments and to submit it for consideration at the next meeting.

Valeriy Bokarev and Associate Professor of the Department of Administrative and Financial Law at the Faculty of Law of St. Petersburg State University Vladislav Savinykh spoke about the draft Model Law on State Cadastral Valuation. Itwill ensure the transparency and efficiency of public bodies and organizations involved in the state cadastral valuation procedure, will increase the protection of individuals in relations related to the determination of cadastral value, increase the economic efficiency of property taxation for the state due to the greater legitimacy of the results of determining the taxable value of property.

At the meeting it was proposed to finalize the draft law taking into account the suggestions and comments voiced.

Deputy Chair of the IPA CIS Permanent Commission on Legal Issues, Chair of the Standing Committee of the Council of the Republic of the National Assembly of the Republic of Belarus on Legislation and State Building Sergey Sivets presented a draft Model Law on Liabilities from Public Promises of Award, Public Tenders, Games and Betting.

Professor of the Department of Civil Law of the Northwestern Branch of the Russian State University of Justice Askhat Kuzbagarov, who represented the developers of the document, briefly outlined the main components of the concept of the Model Law. The members of the commission proposed to revise the draft law taking into account suggestions and comments and submit it for consideration at the next meeting.

Member of the commission, ember of the Committee of the Federation Council of the Federal Assembly of the Russian Federation on Constitutional Legislation and State Building Elena Mizulina proposed to amend the Regulations on Drafting of Model Laws and Recommendations of the CIS Interparliamentary Assembly and the Regulations on the IPA CIS Permanent Commissions. It was decided to finalize the draft amendments taking into account the voiced suggestions and comments.

Yuriy Kozlov informed about the meeting of the working group on the development of the draft Regulations on the Deputy Secretary General of the IPA CIS Council – Plenipotentiary Representative of Parliament in the IPA CIS held on 2 March 2023.

The members of the commission considered the issue on the results of the commission’s work in 2022.

Ravshan Rajabzoda spoke about the use of model laws adopted by the IPA CIS on the initiative of the IPA CIS Permanent Commission on Legal Issues in the legislative activity of the Parliament of the Republic of Tajikistan. He cited a number of documents adopted by the Parliament of the Republic of Tajikistan, implementing the provisions of the IPA CIS documents.

The Commission was attended by representatives of the parliaments of the Azerbaijan Republic, the Republic of Belarus, the Republic of Kazakhstan, the Republic of Moldova, the Russian Federation, the Republic of Tajikistan and the Republic of Uzbekistan.
